This Agreement is entered into between:

• Photographer: AboutLove Photography (“Photographer”)

• Client: (“Client”)

By booking a session with the Photographer, the Client agrees to the following terms and conditions.

1. SCOPE OF SERVICES

The Photographer agrees to provide professional photography services based on the session type selected by the Client.

Services include:

• A photography session at an agreed location and date.

• Professional editing of the selected images.

• Delivery of final edited images within the standard turnaround time.

2. PAYMENT & FEES

• A non-refundable retainer is required to secure the session date.

• The remaining balance must be paid before or on the day of the session.

• Images will be delivered once full payment is received.

Refund Policy:

Retainers are non-refundable. Payments are non-refundable after the session has taken place.

3. USAGE RIGHTS & LICENSING

Personal Use:

The Client receives personal-use rights for the delivered images, including printing, sharing with family and friends, and posting on social media with credit to the Photographer.

Commercial Use:

If images will be used for business, branding, marketing, or website purposes, a commercial licensing fee applies. The Client must notify the Photographer in advance.

Copyright:

All images remain the property of the Photographer.

RAW files are not provided.

4. RESCHEDULING & CANCELLATIONS

• If the Client needs to reschedule, please notify the Photographer at least 2 days in advance.

• Weather or unexpected circumstances may require rescheduling to the next available date.

• Retainers are non-refundable in case of cancellation.

5. MODEL RELEASE & IMAGE USAGE

By booking a session, the Client grants the Photographer permission to use selected images for portfolio, website, and promotional purposes.

Confidentiality Option:

Clients who prefer their images to remain completely private may request a confidentiality add-on:

• $100 for mini sessions

• $150 for full sessions

6. LIABILITY

The Photographer is not responsible for unforeseen conditions such as weather, location restrictions, or natural elements.

The Client agrees to participate at their own discretion and releases the Photographer from liability for injuries or property damage that may occur during the session.

7. RESPECTFUL ATMOSPHERE

The Photographer aims to create a warm, comfortable, and respectful environment.

Kind and clear communication helps ensure an enjoyable session.

If conditions prevent a positive working atmosphere, the Photographer may reschedule or discontinue the session.

8. CHILD BEHAVIOR & COOPERATION

The Photographer gently guides children and adults throughout the session.

However, final results depend on each participant’s cooperation and mood.

Reshoots or refunds are not provided for uncooperative behavior.

9. OUTDOOR CONDITIONS

Outdoor sessions may involve wind, insects, uneven terrain, or changing weather.

Please prepare accordingly.

The Photographer is not responsible for natural environmental factors.

10. ARTISTIC STYLE & CREATIVE JUDGMENT

The Client acknowledges that they are familiar with the Photographer’s style.

The Photographer selects and edits the best images in their artistic judgment.

RAW files are not released.

11. NO REFUNDS FOR SUBJECTIVE DISSATISFACTION

Once images are delivered as agreed, the Photographer’s obligations are fulfilled.

Refunds or reshoots are not offered based on personal preference or appearance.

12. FINAL IMAGE SELECTION & RAW FILES

The Photographer’s selection and editing process is final.

RAW files are never provided.

13. LATE ARRIVAL / MISSED SESSION

Sessions begin and end at the scheduled time.

Late arrivals do not extend session duration.

14. PHOTOGRAPHER’S RIGHT TO RESCHEDULE OR DECLINE SERVICE

The Photographer may reschedule or decline service if conditions do not allow for a safe or respectful working environment.

15. USE OF IMAGES FOR ADVERTISING & PROMOTION
The Client acknowledges and grants permission for the Photographer to use selected images for promotional or advertising purposes, online and offline.

16. TRAVEL FEE

A travel fee of $50 applies for sessions requiring more than 40 minutes of travel (one way) from Brooklyn, NY.

17. DISPUTE RESOLUTION

Any disputes arising from this Agreement will first be addressed through private mediation before pursuing legal action.

18. TURNAROUND TIME

Final edited images will be delivered within 7–14 calendar days after the session.

19. IMAGE SELECTION

After the session, the Client will receive an online proofing gallery to choose their favorite images.

The number of edited images included depends on the selected package.

Additional edited images may be purchased for $10 per image.
